Hyderabad: Danam Nagender on Saturday filed a Special Leave Petition (SLP) in the Supreme Court challenging the Telangana High Court verdict that disqualified him as Khairatabad MLA.
Nagender filed the petition on Saturday afternoon. It remains to be seen whether the Supreme Court will grant leave to appeal and when the matter will be taken up for hearing.
If the Supreme Court grants leave in the SLP, Nagender will be able to pursue an appeal against the High Court judgment.
BJP MLA Aleti Maheshwar Reddy and BRS MLA Padi Kaushik Reddy have already filed caveats in the case.
The High Court on Friday disqualified Nagender, who was elected from Khairatabad on a BRS ticket before defecting to the Congress. It held that his disqualification would take effect from April 23, 2024.
The court delivered a 91-page judgment while setting aside the Speaker’s decisions dismissing the disqualification petitions filed against Nagender.
The High Court allowed petitions filed by the BRS and BJP seeking to overturn the Speaker’s decision.
Danam Nagender disqualified from April 23, 2024
The High Court noted that Nagender remained a BRS member while contesting the 2024 Lok Sabha election from Secunderabad as a Congress candidate.
On that basis, the court declared him disqualified under Paragraph 2(1)(a) of the Tenth Schedule read with Article 191(2) of the Constitution.
Following the disqualification, the High Court said the Khairatabad Assembly constituency should be treated as vacant.
The court also directed its Registry to send a copy of the order to the Secretary to the Speaker and the Election Commission.
Nagender has now approached the Supreme Court through the SLP challenging that verdict. Further proceedings will depend on whether the Supreme Court grants leave and takes up his challenge.
